The Senate has passed a landmark bill granting the National Oil Spill Detection and Response Agency (NOSDRA) expanded statutory powers to impose heavier financial penalties and criminal sanctions on oil spill violators.
The legislation, titled the National Oil Spill Detection and Response Agency (Establishment) Act (Amendment) Bill, 2026, was passed following the plenary adoption of the report presented by the Senate Committee on Environment.
The newly passed bill amends the original NOSDRA Establishment Act of 2006 to provide a robust legal framework aimed at halting persistent environmental degradation across oil-producing regions, particularly the Niger Delta.
Presenting the committee report on behalf of Chairman Senator Olubiyi Fadeyi, Senate Chief Whip, Senator Tahir Monguno (APC: Borno North) emphasized that legacy fine structures failed to prevent corporate negligence:
The existing fines are not deterrent enough to deter offenders. Oil spills have continued to devastate the environment and destroy livelihoods, particularly fishing and farming in oil-producing communities. This bill introduces criminal liability for spills that damage the environment and deprive citizens of their livelihoods.
Senator Tahir Monguno.
Key highlights of the legislative reform include:
- Introducing custodial sentences for individuals and corporate entities whose actions or omissions lead to catastrophic oil spills and community displacement.
- Significantly increasing statutory fines to match global environmental compliance standards and deter recurring violations.
- Equipping NOSDRA with stronger regulatory enforcement mechanisms to conduct swift investigations and ensure prompt remediation by polluters.
During plenary, the Senate dissolved into the Committee of the Whole to consider the bill clause by clause. Lawmakers unanimously approved Clauses 1 through 12, along with the short title, explanatory memorandum, and long title. Upon reverting to plenary, the bill was read for the third time and formally passed.
Senate President Godswill Akpabio commended the Committee on Environment for its diligent work and congratulated NOSDRA on its upgraded mandate.
This legislation grants NOSDRA the essential teeth needed to enforce compliance and safeguard our host communities from avoidable environmental devastation.
Senator Godswill Akpabio.
The bill will now be transmitted to the House of Representatives for concurrence before being forwarded to the President for presidential assent.
